Permission to utilise an invention of significance to the defence of the realm
Applications to the Norwegian Armed Forces for permission are sent to the Norwegian National Security Authority (NSM) for processing on behalf of the Norwegian Armed Forces.
Criteria/conditions:
If anyone wishes to utilise an invention as mentioned in Section 2 of the Act relating to inventions of significance to the defence of the realm, he/she must submit a complete written presentation of the invention to the Norwegian Armed Forces, or submit an application for a patent in the ordinary manner to the Norwegian Industrial Property Office (NIPO) if you wish the invention to be legally protected as industrial property.
Case processing deadlines:
The application is processed within the deadlines stipulated by the Public Administration Act, following the regulations for handling cases under the Act on Inventions of Significance for the Defense of the Realm.
Fee:
There is no fee for processing applications.
Right of appeal:
A decision can be appealed to the Ministry of Defence
Industrial property rights:
To obtain legal protection (industrial property rights) for an invention, a patent application must be filed with the Norwegian Industrial Property Office. If you believe that the application may be of significance to national defence, you should inform the Norwegian Industrial Property Office when submitting the application. This can be done, for example, by marking an envelope containing the application “Defence-related application” and then placing this envelope inside a plain outer envelope, which is either sent by post to the Norwegian Industrial Property Office or delivered in person. Applications that are covered by the Act, or that you believe may be covered by the Act, must not be submitted through electronic channels (such as Altinn or e-mail).
